SUNNY 105.9’s Rock N Reel Fishing Tournament

OFFICIAL RULES

1. HOW TO ENTER

a. These rules govern the Rock N Reel promotion (the “Promotion”) being conducted by WOCL-FM (the “Station”) beginning on Monday, August 17th, 2009 at 12:01am ET and ending on Saturday, October 10th, 2009 4pm ET.

b. To participate in the Promotion, you must complete a tournament application (the “Application”) and submit a tournament fee (the “Fee”) as described herein. Applications submitted by October 1, 2009 have a $200 Fee. Applications submitted between October 2, 2009 and October 9, 2009 have a $250 Fee. All Applications must be submitted by the Boat Captain and contain the following information: Boat Captain’s first name and last name, complete address, city, state, zip code, telephone number, date of birth and your boat name, boat ID number, boat make, list of team members and your e-mail address and payment option by check or credit card. If credit card, then credit card information to be provided (Visa, Master Card or American Express) is credit card number, name on card and expiration date. To submit your Application, you may do so via the following methods:

Online: Application will be available on-line between August 17th, 2009 at 12:01am and October 9th, 2009 at 12pm ET at www.sunny1059.com. Follow the links and instructions to complete and submit your Application. Only one internet entry per person and one internet entry per email address is permitted. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible for assigning an email address or the domain associated with the submitted email address. Multiple participants are not permitted to share the same email address. All entries submitted become the sole property of the Station and will not be acknowledged or returned. Use of any device to automate entry is prohibited. Proof of submission of an entry shall not be deemed proof of receipt by Station. Station’s computer is the official time keeping device for the Promotion. The Station is not responsible for entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties and other technological problems. All Applications submitted online must be received by 12pm ET on October 9, 2009.

In Person: Complete an Application at any of the locations listed below on the dates and times specified.
• CBS Radio Orlando, 1800 Pembrook Drive Suite 400, Orlando, Florida 32810 during regular business hours (M-F 9a-5p excluding holidays) between August 17th, 2009 and October 9th, 2009 at 12pm ET
• Aquarium Restaurant, 125 Basin Street, Daytona Beach, Florida, 32114 during normal business hours between August 17th, 2009 and October 9th, 2009 at 5:00p ET
• Captain’s Party at Aquarium Restaurant, 125 Basin Street, Daytona Beach, Florida, 32114 between 7:30pm and 8:30pm ET on October 9, 2009
• Parker Boats (2 locations) 455 S. Lake Destiny Road, Orlando, Florida, 32810 or 872 N. Tomoka Farms Road, Daytona Beach, Florida 32124 during regular business hours (excluding holidays) between August 17th, 2009 and October 9th, 2009 at 12pm ET.

Fax: Fax a copy of your completed Application to 407-919-0064. All Application submitted by fax must be received by 12pm ET on October 9, 2009.

c. Fees must be paid using a credit card (VISA, AMEX or Master Card) or check made payable to CBS Radio. Entrants can mail their check to CBS Radio Orlando, 1800 Pembrook Drive Suite 400, Orlando, Florida 32810. Entrants can drop off their Fees in person at any of the locations listed above. Entrants can also fax their credit card information to CBS Radio Orlando at 407-919-0064. All Fees must be submitted with the associated Application by the deadlines noted above or the Application will be disqualified. Application without the Fee will not be accepted.

d. The Station is not responsible for lost, stolen, mangled, misdirected, postage due, illegible, incomplete or late Applications or Fees.

e. Only one (1) application per team and each angler can only belong to one (1) team. Each boat must have a designated captain. Each boat can have one captain and up to an additional 5 anglers. Anglers can only be assigned to one boat. The captain or a member of the team must be present at the Captain’s Party from 7:30pm – 8:30pm at the Aquarium on October 9th, 2009 or will be disqualified and no refund will be given. At the Captain’s Party, WOCL will review the tournament rules and assign each team a number.


2. ELIGIBILITY RESTRICTIONS

a. The Promotion is open to all persons who are 21 years of age or older and who reside in the state of Florida. Employees of Station, its licensee, the licensee’s parent, subsidiary and affiliated entities, Station’s advertising and promotional agencies, its participating sponsors, other radio stations in the Orlando metropolitan area, the members of their immediate families (spouse, parent, sibling or child) and those living in the same household of each (whether related or not), are ineligible to enter or win. This Promotion is subject to all applicable federal, state and local laws and regulations and is void where prohibited.

b. Listeners are eligible to win a prize in a Promotion conducted by the Station only once every sixty (60) days and only once every six (6) months if the prize is valued over $600. Only one (1) winner per household is permitted in any Station promotion.

c. Winners must provide valid government-issued photo identification and provide their complete address, date of birth and phone number to claim a prize.

d. Entrants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Station will disqualify any entry from individuals who do not meet the eligibility requirements. The Station will also delete any entry knowingly received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act.

e. All entrants must meet the eligibility requirements described herein.

f. All participants are responsible for boat, fishing and/or any other licenses that may be required.

g. All participants, including Boat Captains and anglers, will be required to sign a release prior to participating in the fishing portion of the Promotion.


3. PRIZES

a. The following cash prizes may be awarded in this Promotion. Each prize consists of the following:

Kingfish: 1st place $1,000; 2nd place $750; 3rd place $500
Dolphin: 1st place $1,000; 2nd place $750; 3rd place $500
Wahoo: 1st place $1,000; 2nd place $750; 3rd place $500

Largest Bottom Fish: Grouper $500 and Snapper $500

Prizes will only be awarded to the Boat Captain no matter which angler caught the fish unless the Boat Captain signs a release designating another individual or entity to receive prize. If no one catches a fish in a particular category, then no prizes will be awarded for that category.

Only applicants received by October 1st, 2009 will be guarantee an event t-shirt and goody bag.

b. Check made payable to winner (Boat Captain) will be mailed to winner’s address (as appears on application) within 4-6 weeks. Captain must sign station contest release and tax form at the tournament or prize will be forfeited.

c. There is no substitution, transfer or cash equivalent for prizes, except that the Station may, at its sole discretion, substitute prizes or cash of comparable value. The prizes are expressly limited to the item(s) listed above and unless otherwise expressly specified, do not include taxes, gratuities or any other expenses. Other restrictions may apply.

4. WINNER SELECTION AND NOTIFICATION

a. Decisions of the Station management with respect to the Promotion are final.

b. On October 10, 2009, all eligible participants can launch their boat from any slip or marina and fish within 60 nautical miles from the Florida East coast, subject to any restrictions contained herein. Lines are allowed in the water at 6:30am ET.The scales will open at 2pm ET.

c. Participants must be in line at the fish weigh-in tent at The Aquarium Restaurant or the Weigh Master must be able to see the boat by 4pm ET on October 10, 2009 or participant will be disqualified and application fee will not be refunded.

d. WOCL-FM will announce winners at the event between approximately 5pm and 6pm ET. Boat Captain must be present at the event in order to win.

e. Prizes will be awarded based on weight of the fish. Prizes are awarded to heaviest fish in each category, not accumulated weight. For the Kingfish, Dolphin and Wahoo category, the boat with the heaviest fish in each category will win the first place prize. The boat with the second heaviest fish in the category will win the second place prize. The boat with the third heaviest fish in the category will win the third place prize. For the largest bottom fish category, the boat with the heaviest Grouper and the boat with the heaviest Snapper will each win the prize for that category. In the event of a tie, the first fish weighted will win the award and the other fish will become eligible for the next lowest category if applicable. The prizes will be awarded to the Boat Captain. The Boat Captain can win in more than one category.

f. Weather: The decision to fish is the choice of each Boat Captain. All anglers fish at their own discretion and risk. If the tournament committee determines, in its sole and absolute discretion, that it is unsafe to fish, all cash awards will still be presented by randomly selecting boat names at the awards banquet. Must be present to win. No entry refunds or rain checks. WOCL-FM will randomly draw for each category from pool of all Team Captains.

g. All fish must be caught on rod & reel (no electric reels). Kites, wire lines, downriggers, & planers are allowed. Live bait, dead bait, and artificial baits are permitted. No restrictions on line test.

h. Fishing in the Bahamas is prohibited.

i. All state and federal recreational fishing rules regarding weight, size, and bag limits must be observed. State fishing license is required by law. Only legal sized fish will be weighed. No billfish will be weighed!

j. No limits to the number of lines a boat may fish.

k. Each boat is allowed to weigh one (1) fish per category.

l. All cash and prizes will be awarded to the Boat Captain, unless the Boat Captain signs a release designating another individual or entity to receive the cash or prize. Any person who wins a prize over $600.00 must provide their social security number, will be required to fill out a W-9 form and could be subject to a polygraph test.

m. Tournament scales open at 2:00pm. No mutilated fish will be weighed. Anglers entering fish must return to the tournament scales from the boat they fished from by 4:00pm and must be weighed in the presence of the weigh master, the angler, or captain and recorded on an official weigh-in form. No fish or anglers can be transferred between boats. It is important to keep your fish adequately iced. All entered fish must be able to pass a Torry Meter and Organoleptic test.

n. Tournament committee will be monitoring channel 71.


5. CONDITIONS

a. Payments of all federal, state and local taxes are solely the responsibility of the winner. The winner will be required to complete and submit an IRS Form W-9 with the winner’s full Social Security Number or the equivalent for receipt of any prize valued at $600 or more or for any prizes awarded by the Station (or any other CBS Radio station in Station’s market) in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in forfeiture of the prize. Such winnings of $600 or more will be reported to the IRS.

b. By participating in the Promotion, the winner agrees to have the winner’s name, voice and likeness used in any advertising or broadcasting material relating to the Promotion without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.

c. Prior to awarding any prize or prize certificate, the Station, in its sole discretion, may require Promotion winner (and any travel companion(s) or guest(s)) to sign a liability release, agreeing to release and hold harmless the Station, its licensee, the licensee’s parent, subsidiary and affiliated entities, their respective officers, shareholders, directors, employees, agents and representatives and all of their successors and assigns from and against any and all claims or liability arising directly or indirectly from the prize and participation in the Promotion.

d. If for any reason this Promotion cannot be executed as planned, including, but not limited to, as a result of infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Station that corrupt or affect the security, administration, fairness, integrity or proper conduct of the Promotion, or if the Promotion is compromised or becomes technically corrupted in any way, electronically or otherwise, the Station reserves the right to cancel, terminate or modify the Promotion. If the Promotion is terminated before the original end date, the Station will select the winners by random drawing from among all eligible non-suspect entries received as of the termination time/date.

e. The Station, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or the operation of the Station’s website. Failure to comply with the rules of the Promotion may result in a contestant’s disqualification and/or forfeiture of any prize or prizes. If the Station makes a good faith determination that an entrant has cheated or committed fraudulent activity in connection with a Promotion, the Station reserves the right to disqualify that entrant from entering and/or winning future Promotions and to prosecute and seek damages to the fullest extent permitted by law.

f. The Station reserves the right to make changes in the rules of the Promotion, including, without limitation, the substitution of a prize of equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Station, any competition or prize-related event or travel is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to cancel or modify the Promotion and shall not be required to award a substitute prize.

g. The Station is not responsible for typographical or other errors in the printing, the offering or the administration of the Promotion or in the announcement of a prize.

h. For a copy of these Official Rules, send a self-addressed stamped envelope for receipt by October 9th, 2009 to Rock N Reel – Official Rules,” Attn: Promotions, WOCL, 1800 Pembrook Drive, Suite 400, Orlando, Florida, 32810. For the names of the prize winners send a self-addressed stamped envelope for receipt by December 10th, 2009 to the above address marked “Rock N Reel – Winner List.” The Official Rules and the Winner List (when completed) shall also be available during regular business hours at the main offices of the Station and shall be posted online at www.sunny1059.com.

6. PRIVACY

a. By use of the Station’s website or by entering the Promotion through the Station’s website, you agree to the website’s Terms of Use Agreement located at www.sunny1059.com and to the use of your personal information as described in the Privacy Policy located at www.sunny1059.com.
